The basic law in the field of biosafety was adopted on May 31, 2007 (№ 1103-V, "On the State Biosafety System in Creating, Testing, Transporting, and Using Genetically Modified Organisms"). In addition, the biosafety issues are regulated by the acts of the Cabinet of Ministers of Ukraine, orders of the central governmental bodies of executive power, the state standards. More than 40 legal acts were adopted during 2007 - 2011. The legislation defines the main principles of state policy on biosafety, including the priority of preserving human health and protecting the natural environment as compared with receiving economic benefits from the application of LMOs. Functions of the central governmental executive bodies are defined as follows:
Ministry of Ecology and Natural Resources is responsible for the introduction of GMOs into the environment, including implementation of the advance informed agreement procedure;
Ministry of Agrarian Policy and Food is responsible for agricultural use of GMOs (crop varieties, animal breeds), microbiological and agricultural products containing, derived from GMOs or obtained from their use;
Ministry of Education, Science, Youth and Sports is responsible for contained use of GMOs; for issuing permits for importation into the customs territory of Ukraine unregistered GMOs for scientific research purposes or state field trials.
Ministry of Health is responsible for the use of food, cosmetic and medicinal products containing, derived from GMOs or obtained from their use;
State Veterinary and Phytosanitary Service is responsible for the use of feed, feed additives and veterinary drugs containing, derived from GMOs or obtained from their use.

Ukraine regulates the transboundary movement, handling, processing and use of GMOs that are used in pharmaceuticals. In accordance with the Law of Ukraine of May 31, 2007 № 1103-V "On the State Biosafety System in Creating, Testing, Transporting, and Using Genetically Modified Organisms" and relevant acts of the Cabinet of Ministers of Ukraine subject to state registration are medicinal, cosmetic and veterinary drugs, microbiological agricultural drugs and feed additives containing, derived from GMOs or obtained from their use. Import into the territory of Ukraine of unregistered GMOs and products containing, derived from unregistered GMOs or obtained from their use is allowed only for conducting research provided issued by relevant state governmental bodies permit.

The Act of Cabinet of Ministers of Ukraine of April 2, 2009 № 308 approved the procedure for issuing permits for state field trials of GMOs. In accordance with this procedure an applicant for a permit for release of GMOs has to present the conclusion of the developer of the GMO about safety of GMO for human health and the environment with references to the scientific research;
permit is valid not more than five years;
introduction into the environment for commercial use is possible only after the finalizing of state field trials (testing) and recording of GMOs into a special state register;
